There is a lack of clarity and practical guidance around how the new definition of sex is applied while continuing to protect trans people under the Equality Act. The proposed guidance could create uncertainty for workers required to implement it and lead to workplace conflict and discrimination

About the consultation

Submissions of evidence to the Equality and Human Rights Commission (EHRC) consultation was reopened in 2025 following the UK Supreme Court judgment on 16 April 2025 in For Women Scotland Ltd v The Scottish Minister.
